General Terms & Conditions

Please read carefully. By registering, placing an order (car rental, driver with car, or sober driver), or using our Platform (“Platform”, “we”, “us”, “our”), you agree to these Terms. If you don’t accept them, do not use our Platform or request any service.

1. Services Offered

We provide the following services via our Platform:

Our Platform acts only as a mediator / facilitator / connector / marketplace — we do not own or operate cars, and we do not directly employ drivers (unless otherwise explicitly stated).

2. Eligibility & Information Accuracy

Users (Renters / Passengers) must be at least 18 years old and legally capable of entering into binding contracts.

When using driver services (with or without car rental), users must provide accurate, complete and truthful information (ID, driver license for themselves if required, contact info, pickup/dropoff locations, car registration if using sober driver service, etc.).

For sober driver service: You must be either the owner or legal user of the vehicle you request a driver for — or have authorization from the owner. The vehicle must be properly registered, insured (if applicable under the law), roadworthy and meet legal requirements. By requesting a service you confirm compliance with local laws and regulations.

4. Separate Service Agreement & Risk Acknowledgement

For every rental or driver service (car rental, driver with car, or sober driver), the binding agreement will be between you (user) and the Car Owner or driver service provider. Our Platform’s Terms do not replace or substitute those service agreements.

For sober driver service: By requesting the service, you accept that the driver will operate your own vehicle on your behalf — you grant permission for this.

You acknowledge that using the service carries risks (vehicle condition, driving risk, road conditions, driver error, external factors such as weather or traffic). You assume all such risks when consenting to the service.

5. Use & Conduct Requirements

When using any service (rental or driver services), you agree that:

If behavior poses risk to driver or others, the driver/provider may refuse or terminate the service. Misconduct may lead to refusal, cancellation, legal consequences, or banning from the Platform.

6. Liability, Disclaimer & Indemnification

We, as the Platform, act solely as intermediary/facilitator. We do not guarantee the condition, safety, roadworthiness, legality, or insurance status of any vehicle, driver or service provider.

We do not guarantee service quality, timeliness, availability, or uninterrupted service. Service is provided “as is” and “as available.”

You accept all risk associated with using these services — including accidents, damage to vehicle or personal injury, theft, loss, or third-party claims.

You (the user) agree to indemnify and hold harmless Umusare Incorporation (our company), its affiliates, agents and employees from any claims, liability, loss, damage or legal costs arising from your use of the Platform or any rental/driver service you request — including misuse, breach of these Terms, or illegal/unlawful acts.

7. Right to Refuse or Cancel Service

We (or service providers: car owners or drivers) reserve the right to refuse, cancel or terminate a booking or ride at any time if:

8. Changes to Terms

We may modify or update these Terms at any time. Updated Terms will be posted on our Platform. Continued use after posting means acceptance of changed Terms.

9. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Rwanda. Any dispute arising under or in connection with these Terms shall be submitted to the courts of Rwanda (or agreed jurisdiction), unless otherwise agreed in writing.
